Update: On Dec. 17, 2012, cases were consolidated by the 4th Circuit (Case Nos. 12-2514, 12-2533 and Case No. 12-1096(L)) and a briefing schedule is set. Opening brief and appendix are due on 1-28-13 and response brief is due on Feb. 28, 2013.

Update: 4th Circuit case calendared for oral argument on May 14, 2013 at 9:30am.
