Bankruptcy Law

Overview

United States bankruptcy law is largely found within title 11 of the United States Code (known as the Bankruptcy Code).  Procedures in bankruptcy courts are governed by the Federal Rules of Bankruptcy Procedure, which is often based on the Federal Rules of Civil Procedure.

The text of the Bankruptcy Code, Federal Rules, and Bankruptcy Rules are available both online and in print.  Additionally, a number of services have created annotated versions of each of these sources, which contain references to relevant judicial decisions, law review articles, and legal encyclopedias.

Local Rules

Most bankruptcy courts have local rules that supplement the Federal Rules of Bankruptcy Procedure. Some individual judges may also have chambers rules.  For the most up-to-date rules, check the court clerk's website and the chambers website for the judge who will be hearing the case.
